New Proposed Social Media Policy for Asylum and Naturalization Applications

GOOD AFTERNOON MY NAME IS ALENA SHAUTSOVA I’M AN IMMIGRATION ATTORNEY FROM BROOKLYN NEW YORK
IN TODAY’S LIVE FACEBOOK PRESENTATION I WOULD LIKE TO TELL
YOU ABOUT NEW PROPOSED RULE PROPOSED BY DEPARTMENT OF HOMELAND
SECURITY RULE THAT WILL AFFECT NATURALIZATION AND ASYLUM PROCEEDINGS
THIS IS A VERY INTERESTING RULE REGARDING SOCIAL
MEDIA USCIS IS PROPOSING BASICALLY THAT APPLICANTS FOR ASYLUM
AND APPLICANTS FOR NATURALIZATION WILL SHARE THIS SOCIAL
MEDIA ACCOUNTS WHILE THEY APPLYING FOR VARIOUS BENEFITS AND
RIGHT NOW THERE IS A LIST OF ABOUT 19 OR 20 VARIOUS SOCIAL MEDIA
WEBSITES INCLUDING FACEBOOK AND YOUTUBE AND RUSSIAN NETWORK
VKONTAKTE THAT INCLUDED ON A LIST OF ACCOUNTS THAT SHOULD BE
SHARED RIGHT NOW THE PROPOSED RULE STATES THAT AN APPLICANT WOULD
HAVE TO SHARE JUST THEIR USER NAME AND NOT THE PASSWORD IT MEANS
THAT THE USERNAME WILL BE USED FOR SEARCH IN CONNECTION WITH
PUBLICLY AVAILABLE INFORMATION FROM WHAT I UNDERSTAND
BUT HERE IS A TRICKY SITUATION HERE THERE ARE TWO CREDIBLE
REPORTS PUBLISHED BY THE MEDIA STATING THAT TWO APPLICANTS
FOR VISAS WERE DENIED BECAUSE CBP AGENTS AND THIS RULE
BY THE WAY ALREADY IN PLACE FOR THOSE WHO ARE COMING TO THE
UNITED STATES SO CBP AGENTS DETERMINED THAT BECAUSE PERSON’S
FRIENDS PERSON’S FRIENDS ON SOCIAL MEDIA WE’RE SHARING SOME
INFORMATION THAT THEY FOUND TO BE UNACCEPTABLE FOR THE UNITED
STATES POLICIES AND VIEWS THE PEOPLE AT THE BORDER WERE DENIED ADMISSION IT MEANS THAT SOMETIMES APPARENTLY YOU CAN BE
PUNISH FOR WHAT YOUR FRIENDS NOT EVEN YOU ARE SHARING ON SOCIAL MEDIA THERE ARE OTHER QUESTIONS FOR THIS POLICY AS WELL YOU LIKE SOMETHING WILL EXPRESS
AND EMOJI RIGHT I BELIEVE THAT’S HOW YOU PRONOUNCE THAT IN
CONNECTION WITH AN ARTICLE EMOJI SAYS WE KNOW ARE SUBJECT TO
INTERPRETATION FOR EXAMPLE THERE IS AN ARTICLE AND YOU PUT
A NAME ANGRY FACE ARE YOU ANGRY BECAUSE YOU DISAGREE WITH IT ARE
YOU ANGRY BECAUSE YOU AGREE WITH THAT SO I THIS THIS POLICY
WILL END UP IN MORE CONFUSION THAN CLARITY AND UNFORTUNATELY
I BELIEVE THERE WILL BE A ROOM FOR ABUSE HERE NOW USCIS
STATED THAT THE POLICY WILL BE IN EFFECT FOR
FOR THESE FORMS: N-400 FORM THIS APPLICATION WHICH EVERY EVERY GREEN CARD HOLDER HAS SUBMIT SO
I AM NOT SURE HOW THE TO IMPLEMENT THE POLICY IS IT GOING
TO BE ONLY FOR THOSE WHO RECEIVE GREEN CARDS BASED ON A SILENT
OR FOR EVERYONE ELSE WHO IS APPLYING FOR INTERNALIZATION
FORM I 485 THIS FORM IS USED TO APPLY FOR GREEN CARD FOR
PERMANENT RESIDENT STATUS ALSO iNOT CLEAR IF IT’S ONLY FOR THOSE
WHO ARE APPLYING AFTER THEY GOT ASSEMBLY STATUS OF FOR EVERYBODY
ELSE I 730 FOUR THAT’S THE FORM USED BY ASYLEES REFUGEES
TO THEIR FAMILY MEMBERS TO GIVE GIVE THEM STATUS INTO THE UNITED
STATES AND I WANT 30 ONE FORM THAT’S A FORM FOR ADVANCE
PAROLE TRAVEL DOCUMENT THAT ONE GOT ME BECAUSE BASICALLY THEY’RE
SAYING THAT WE WILL NOT AUTHORIZE TO TRAVEL OUTSIDE OF THE
UNITED STATES IF WE FIND THAT YOUR SOCIAL MEDIA IS NOT TRUSTWORTHY
OR SOMETHING I’M NOT NOW THIS IS NOT THE RULE YET THIS
RULE THIS RULE IS BASICALLY DEPARTMENT OF HOMELAND SECURITY
IS SEEKING COMMENTS ON THIS RULE BUT THIS IS SOMETHING THAT
YOU NEED TO BE AWARE OF AND POSSIBLY TO BECOME OUR REALITY PERHAPS
EVEN BY THE END OF THIS YEAR YOU CAN READ MORE ABOUT VARIOUS
IMMIGRATION BENEFITS ON OUR WEBSITE WWW.SHAUTSOVA.COM
